How to Write an AI Usage Policy for Your Business
Most small businesses don't have an AI usage policy. Most of their employees are using AI tools anyway. That gap — between what's happening and what's been thought through — is where data exposure, compliance problems, and liability tend to accumulate. An AI usage policy doesn't need to be a lengthy legal document. It needs to answer five questions clearly enough that any employee knows what to do without asking.

Why a policy matters more than a ban
Blanket bans on AI tools don't work in practice. Employees use them on personal devices, through browser extensions, or through tools that have integrated AI without announcing it. A ban with no policy just means AI use happens without guidelines. A clear policy that defines what's acceptable gives you something to point to, something to train on, and something to enforce if needed — while letting your team benefit from tools that genuinely make them more productive.
The five questions your policy needs to answer
1. Which AI tools are approved?
Name the specific tools employees are permitted to use for work. This removes ambiguity and lets you ensure approved tools have appropriate data handling terms. Example: "Approved tools include Microsoft Copilot (via M365), Claude Pro (company account), and ChatGPT Team (company account). Personal or free accounts are not approved for work use."
2. What data can and cannot go into AI tools?
This is the most important section. Be specific: client names and contact information, financial records, contracts, health information, employee data, and credentials should be explicitly listed as prohibited inputs. Describe what can be used: internal draft text, publicly available information, non-sensitive internal communications.
3. Who is responsible for reviewing AI output?
AI makes mistakes — sometimes confidently. Your policy should be clear that AI-generated content is a draft, not a finished product, and that the employee who submits or publishes it is responsible for its accuracy. This matters especially for anything client-facing, legal, financial, or compliance-related.
4. What are the consequences of misuse?
Policies without consequences are suggestions. Be clear that sharing confidential data with unauthorized AI tools is a policy violation with the same treatment as other data security incidents. This doesn't need to be harsh — it just needs to exist.
5. How should employees report concerns?
If an employee realizes they've accidentally put sensitive data into an AI tool, they should know who to tell and that reporting it won't get them fired. Creating psychological safety around reporting incidents is how you find out about problems before they become breaches.
Format and length
Keep it to one or two pages. A policy employees can actually read is infinitely more effective than a comprehensive 20-page document nobody opens. Use plain language, not legal language. Have a manager walk new employees through it during onboarding rather than just emailing a PDF. Review it annually — AI tools are evolving fast, and what's accurate today may need to be updated in 12 months.
Industry-specific considerations
If your business operates under specific regulatory frameworks, your AI policy needs to reflect those requirements:
- Healthcare — HIPAA requires safeguards for protected health information (PHI). Inputting patient information into a non-BAA AI tool is a HIPAA violation.
- Finance — Financial data, client account information, and investment strategies should be treated as confidential and kept out of consumer AI tools.
- Legal — Attorney-client privilege considerations apply. Confidential client matters should not be processed through AI tools without understanding the data handling implications.
- Retail and payments — Payment card data should never enter an AI tool. This is both a data security best practice and a PCI DSS requirement.
